How do I know if I'm being paid minimum wage?

What deductions can bring my pay below minimum wage?

Only accommodation provided by your employer (above the offset rate) can count towards minimum wage. Deductions for uniforms, equipment, or other things cannot reduce your pay below the minimum wage.

Can I report my employer anonymously?

Yes. Use the official GOV.UK pay and work rights form. HMRC enforces NMW on behalf of the Fair Work Agency and will not tell your employer who made the complaint if you ask them not to.

How far back can I claim underpaid wages?

You can claim underpaid wages going back up to 6 years through an employment tribunal or civil court. HMRC can also investigate back 6 years.

What happens if HMRC finds my employer underpaid me?

Your employer must repay the underpayment at current NMW rates (not the historical rate), plus a penalty of up to 200% of the underpayment.
